E-signatures and Indonesian law
Indonesian law recognizes electronic signatures. Signatures on Lookdocu are uncertified electronic signatures, and every completed document carries proof of who signed, when and from where. This page explains what that means and where the limits are.
The law
What the regulations say
In general terms, and not as legal advice for your document.
- UU ITE
- The Electronic Information and Transactions Law gives an electronic signature legal force and legal effect when it meets the conditions the law sets, among them that the signer can be identified and that changes made after signing can be detected.
- PP 71/2019
- Government Regulation 71/2019 recognizes two kinds of electronic signature: certified, made with an electronic certificate from an Indonesian Electronic Certification Provider (PSrE), and uncertified, made without one.
- Your document
- Some documents, by regulation or by agreement with the other party, need a certified electronic signature, an e-meterai or a notarial deed. Check what yours needs, with a lawyer when in doubt.
Lookdocu
Where Lookdocu stands
What the platform provides today, and what it does not.
- Signatures
- Uncertified electronic signatures under UU ITE and PP 71/2019.
- PSrE certificate
- Not yet. Lookdocu signatures and e-stamps do not use a certified electronic certificate from an Indonesian PSrE. For documents that require one, use a PSrE service.
- E-meterai
- Lookdocu does not apply an e-meterai. Review Document can point out when an agreement has no place for one, and Extract Data flags a receipt over Rp 5,000,000 without a meterai.
- Notarial deeds
- Not a replacement for a deed made before a notary.
Proof
The proof every document carries
Each completed document ends with a certificate page, and anyone can check that the file is the one that was signed.
-
Certificate of Completion
Added to every final PDF: the recipients, timestamps, IP addresses and the SHA-256 fingerprint of the original file.
-
Audit trail
Created, sent, opened, signed, declined and cancelled, each with the time, the email of the person who acted and the IP address.
-
SHA-256 fingerprint
A short code computed from the original file. Change anything in the file and the fingerprint no longer matches.
-
Public Verify page
Anyone can check a final PDF or a stamp code on the Verify page. The file is checked in the browser and never uploaded.
-
Signing as the right person
For each recipient you can require sign-in with the email address the document was sent to.
-
No changes after sending
A sent document cannot be edited. To correct it, cancel it and send a new version.
Before you sign
Contracts checked against Indonesian law
Review Document points to what to check with a lawyer. It does not replace one.
For contracts, the review checks among other things:
- Bahasa Indonesia for a contract with an Indonesian party
- Signatories and their authority (KUHPerdata 1320)
- The e-meterai on an agreement used as evidence
- Personal data under UU PDP
- For employment: PKWT probation, minimum wage, working hours and BPJS
